Taking his obviously not really hypothetical seriously, the conduct Halper is defending involves implying the plaintiff, a Russian-born academic, was a Russian agent attempting to seduce Michael Flynn as part of an entrapment scheme. These rumors were probably meant to damage Flynn's reputation, and were probably spread in official reports as well as leaks to news media. That seems like a cut and dried defamation case if the reports were false.
